1. Agreement to Terms
By accessing or using Kapeka's services, you agree to be bound by these Terms of Use. If you disagree with any part of these terms, you may not access our services.
2. Services
Kapeka provides custom software development services including websites, web applications, booking systems, online stores, and other digital solutions. The specific scope, deliverables, and pricing for each project are defined in individual project agreements.
3. Project Agreements
Each project is governed by a separate project agreement that outlines:
- Project scope and deliverables
- Timeline and milestones
- Pricing and payment terms
- Intellectual property ownership
- Support and maintenance terms
4. Intellectual Property
Unless otherwise specified in your project agreement, upon full payment you own the custom code developed specifically for your project. Third-party libraries, frameworks, and tools remain subject to their respective licenses.
5. Payment Terms
Payment terms are specified in your project agreement. For one-time fee projects, a deposit is typically required before work begins. Revenue share arrangements are billed monthly based on agreed-upon terms.
6. Hosting and Maintenance
Hosting and maintenance services are provided on a monthly subscription basis. These services can be cancelled with 30 days notice. We are not responsible for data loss if you choose to discontinue hosting services.
7. Limitation of Liability
Kapeka shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.
8. Termination
Either party may terminate a project agreement as specified in that agreement. Upon termination, you will receive all completed work up to the termination date, subject to payment of any outstanding amounts.
9. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services constitutes acceptance of the modified terms.
